Terms and Conditions for Clear Path Veterans

Welcome to Clear Path Veterans. By engaging our services or using our website, you agree to be bound by the following Terms and Conditions.

1. Scope of Services

Clear Path Veterans provides advocacy, support, and administrative services to assist Australian veterans ("the Client") in preparing and lodging claims with the Department of Veterans' Affairs ("DVA").

Our services include, but are not limited to:

  • Reviewing client circumstances and advising on potential DVA entitlements.
  • Assisting in gathering required medical and service-related evidence.
  • Preparing and lodging claim documentation with the DVA.
  • Liaising with the DVA on the Client's behalf.

2. Disclaimer: No Guarantee of Outcome

Clear Path Veterans provides expert guidance and administrative support. However, we do not provide legal or medical advice. We do not and cannot guarantee the outcome of any claim submitted to the DVA. All decisions regarding claims, liability, and compensation are made solely by the DVA.

3. Client Obligations

The Client agrees to:

  • Provide all information requested by Clear Path Veterans in a timely, accurate, and truthful manner.
  • Sign an "Authority to Act" form, granting us permission to access your information and act on your behalf with the DVA and relevant third parties.
  • Inform us immediately of any changes to your contact details, medical condition, or other circumstances relevant to your claim.
  • Understand that providing false or misleading information may jeopardise your claim and could result in legal consequences from the DVA.

4. Fees and Payment

All fees for our services will be clearly outlined in a separate Service Agreement provided to you before the commencement of our work. You agree to pay all fees in accordance with the terms set out in that Service Agreement.

5. Confidentiality and Privacy

We are committed to protecting your privacy. All personal and sensitive information you provide will be handled in strict accordance with our Privacy Policy, which forms a part of these Terms and Conditions.

6. Limitation of Liability

To the fullest extent permitted by law, including the Australian Consumer Law, Clear Path Veterans shall not be liable for any loss, damage, or cost arising from:

  • The DVA's decision on your claim.
  • Any delay in the claim process caused by the DVA or other third parties.
  • Inaccuracies or omissions in the information provided by the Client.

Our liability in connection with our services is limited to the value of the fees paid by the Client for those services.

7. Intellectual Property

All content on our website and in our documentation, including text, graphics, and logos, is the property of Clear Path Veterans and is protected by copyright law. It may not be used or reproduced without our prior written consent.

8. Termination

Either party may terminate the Service Agreement in writing. If the Client terminates the agreement, the Client may be liable for fees for work already completed. Clear Path Veterans reserves the right to terminate the agreement immediately if the Client provides false information or otherwise breaches these terms.

9. Governing Law

This agreement is governed by the laws of Queensland, Australia. Both parties agree to submit to the exclusive jurisdiction of the courts of Queensland.
